Terms of Service

These terms cover the Opsis website, waitlist, early access, desktop app, and related cloud features. By using Opsis, you agree to them.

1. Agreement

By accessing opsis.app, joining the waitlist, creating an account, or using the Opsis application, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. The service

Opsis provides tools that map how you work, answer questions from your history, support Offline Sessions, surface insights, and help you turn repeated workflows into skills. Features may change, appear first in early access, or differ by platform and plan.

Early access builds can be incomplete, unstable, or withdrawn. We do not guarantee uninterrupted availability.

3. Eligibility

You must be at least 16 years old and able to form a binding contract. If you use Opsis on behalf of an organisation, you represent that you have authority to bind that organisation.

4. Accounts

You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it current. Notify us promptly if you suspect unauthorised access.

5. Acceptable use

You agree not to:

  • Misuse capture features to violate others' privacy or rights
  • Attempt to break, probe, or overload our systems
  • Reverse engineer the product except where local law allows
  • Resell, sublicense, or scrape Opsis without our written consent
  • Use Opsis for unlawful, harmful, or deceptive purposes

6. Your content and device data

You retain rights to the work and device data processed by Opsis. You grant us a limited licence to process that data solely to provide and improve the service, as described in the Privacy Policy. You are responsible for having the rights and permissions needed for what you choose to capture.

7. Intellectual property

Opsis, including software, branding, and site content, is owned by us or our licensors. These terms do not transfer ownership to you. You receive a personal, non-exclusive, non-transferable licence to use the app as offered.

8. Third-party services

Opsis may rely on providers for auth, hosting, email, and model inference. Your use of those layers is also subject to their terms where applicable. We are not responsible for third-party services we do not control.

9. Disclaimers

Opsis is provided "as is" and "as available." Insights, Query answers, Offline Session labels, and automation suggestions are assistive. They are not professional advice and may be incomplete or wrong. You decide how to act on them.

To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Opsis and its founders will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our aggregate liability for claims relating to the service is limited to the greater of AUD $100 or the amounts you paid us for Opsis in the 12 months before the claim.

11. Termination

You may stop using Opsis at any time. We may suspend or terminate access if you breach these terms, create risk, or if we discontinue the product. Sections that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.

12. Changes

We may update these terms. Continued use after an update means you accept the revised terms. If you do not agree, stop using the service.

13. Governing law

These terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules. Courts in Victoria have exclusive jurisdiction, except where mandatory consumer protections say otherwise.
